OpenOcean Terms of Service and End User Licence
Effective date: 20 October 2026
These terms are an agreement between you and OPENOCEAN HUB PTE. LTD., a company registered in Singapore at 68 Circular Road, #02-01, Singapore 049422 ("OpenOcean", "we", "us"), for the OpenOcean mobile app and the services behind it (together, the "Service"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service. Our Privacy Policy (openoceanhub.com/privacy), Copyright Policy (openoceanhub.com/copyright) and data attributions (openoceanhub.com/attributions) are part of these terms.
1. Not for navigation
On the dock: Everything OpenOcean shows you about the water can be wrong. Use it to plan and to understand, never as the thing you steer by. You are the skipper; the chart, the notices and your own eyes are the authority.
1.1 Not for navigation. Cross-check official sources. OpenOcean's maps, weather, and guidance are advisory only — they can be incomplete, out of date, or wrong, and they don't replace official charts, notices to mariners, or your own instruments. You are responsible for the vessel; confirm depths, hazards, and aids to navigation against an official source before you act.
1.2 In particular, and without limiting 1.1:
(a) Maps and places. The base map is a general-purpose map, not a nautical chart, and the Service contains no official chart data. Anchorages, marinas, depths, moorings, hazards, prices, opening hours, contact details, reviews and guidance shown in the Service come from public datasets, licensed data providers and other users, and are unverified. Any of them may be outdated, mislocated, or simply wrong. Depth information in particular is never survey data and must not be relied on.
(b) Weather, tides and ocean data. Forecasts, warnings, radar and satellite images, tide predictions and currents are the output of numerical models and observation networks operated by third parties, re-processed by us, and shown with an age. A forecast is a forecast. Model data can be late, missing, or wrong, and the Service may show a stale or empty layer rather than a wrong one. Where the Service prints "—", it has no value; never treat that as zero or as safe.
(c) AIS vessel traffic. The AIS layer comes from a community network of shore receivers. It has no satellite coverage, misses many vessels (in particular small craft and any vessel out of range of a receiver), can be minutes old, and can show a vessel where it no longer is. It must not be used for collision avoidance or to satisfy any lookout or watch-keeping obligation. Nothing in the Service replaces a proper lookout under the Collision Regulations.
(d) Translations are machine translations and may be wrong in ways that matter.
(e) Licence conditions. Several data sources we use grant their licences on the express condition that the data is not used for navigation or safety of life at sea, and disclaim all liability for it. That condition passes to you: you may not use any data obtained through the Service as a primary means of navigation, and you accept that those providers, like us, accept no liability for it.
1.3 You are responsible for the safe operation of your vessel, for carrying and using the official charts, publications and equipment required for your waters, and for every decision you take on the water. The Service is a planning and information aid, and using it does not transfer any part of that responsibility to us.
2. Safety features are aids that can fail
On the dock: Anchor Watch, SOS, check-ins and buddy alerts are useful, and they all sit on top of a phone, a GPS, a battery, a network and other companies' delivery systems. Any link in that chain can break, silently. Keep a proper watch; carry an EPIRB or DSC radio; call the coastguard.
2.1 The Service includes features intended to help with safety: Anchor Watch and Lookout devices, SOS, scheduled check-ins, buddy alerts, crew location, weather watch areas and warnings (together, "Safety Features"). Every Safety Feature depends on things we do not control: your device and its settings, GPS accuracy, battery, operating-system limits on background execution, network and mobile-data coverage at sea, push-notification delivery by Apple, Google and Expo, and email or SMS delivery by third-party providers.
2.2 We do not promise that any alert, alarm, notification, message or broadcast will be delivered, delivered in time, or delivered at all. A Safety Feature that reports "sent" has handed a message to a third-party system; it has not confirmed that anyone received it.
2.3 Safety Features are not a substitute for a proper anchor watch and lookout, for an EPIRB, PLB, AIS transponder or DSC-equipped VHF radio, or for contacting the coastguard or rescue services directly. In an emergency, use the proper distress equipment and channels first.
2.4 Buddy contacts and emergency contacts are people you nominate. You are responsible for having their agreement to be contacted, for keeping their details current, and for what they do or do not do with an alert. An SOS you trigger is visible to other users of the Service while it is active; other users are under no obligation to respond, and we do not vouch for anyone who does.
3. Who can use OpenOcean
On the dock: Adults. The store rating is 17+; nobody under 16, anywhere.
3.1 You must be at least 16 years old, and at least the age at which you can agree to these terms without a parent's consent where you live, to use the Service. The Service is not directed at children and carries a 17+ rating in the app stores.
3.2 You must not use the Service if you are barred from doing so under the laws of your country, or if we have previously terminated your account for breach of these terms.
4. Your account
On the dock: One person, one account, your real details, your password. You can delete the account yourself in the app. We can close accounts that break these terms, and we will tell you why.
4.1 You need an account to use the Service. Give accurate information and keep it current. Keep your password secure; you are responsible for activity under your account unless it results from our breach. Tell us at support@openoceanhub.com if you believe your account has been compromised.
4.2 Onboard device accounts (for a Lookout or transponder device paired to your boat) are created and controlled by you and are subject to these terms as part of your account.
4.3 Deleting your account. You can delete your account at any time in Settings. What is deleted, what is anonymised and what is kept is set out in the Privacy Policy (section 14). If you cannot access the app, email support@openoceanhub.com from your account address. You may first need to hand over or delete a boat that still has crew.
4.4 Suspension and termination by us. We may suspend or terminate your account, or remove content, if you breach these terms, if the law requires it, or if your use creates a risk for other users or the Service. Where the law requires, and in any case where it is reasonably practicable, we will tell you what we did and why, and you can contest the decision by writing to support@openoceanhub.com; a person will review it. Repeat or serious breaches (including repeated upheld copyright reports — see the Copyright Policy) lead to termination.
4.5 On termination, your licence to use the Service ends. Sections that by their nature should survive (1, 2, 6, 7, 12–15, 17–19) survive.
5. Acceptable use and community rules
On the dock: Be the sailor you would want moored next to you. No harassment, no scams, no stolen content, no posting other people's positions or private details, no gaming the map, no misuse of safety features.
5.1 You must not use the Service to:
(a) harass, threaten, defame or abuse anyone, or post content that is hateful, obscene, sexually explicit, or that exploits children; (b) post another person's private information (including their vessel's position, home port, documents, contact details or images) without their consent; (c) post content you have no right to post (see section 6 and the Copyright Policy); (d) post false or misleading information about places, depths, hazards, anchorages, services or people, or spam, scams, phishing or malware; (e) trigger an SOS or other Safety Feature without a genuine reason, or interfere with someone else's; (f) impersonate any person or vessel, or misrepresent your affiliation with anyone; (g) access the Service by any means other than the app we publish, scrape or bulk-download data (including places, positions, tracks, AIS data or media), probe or overload our systems, or circumvent any access control, rate limit or visibility setting; (h) reverse-engineer, copy, resell or redistribute the app, its data or its media, except as the law expressly allows; (i) use the Service for any commercial navigation, charter, survey or rescue service, or in any way that treats it as a certified navigation or safety system; (j) break the law, or the licence conditions of the data sources listed at openoceanhub.com/attributions.
5.2 Moderation. Place and anchorage contributions pass automated checks; posts, comments and messages are moderated on report, by people:
(a) Contributions to places and anchorages are checked by rules and, for free-text fields, by an automated classifier that records an advisory opinion. Some edits by established contributors publish immediately under those rules and can be corrected later by other users; everything else waits for a person to review it. Nothing is hidden or removed by automated means alone — a person decides. (b) Anyone can report a post, comment, message or user in the app, including for copyright, and anyone — user or not — can send a notice to support@openoceanhub.com. Reports are read by our staff, who can hide content, uphold or dismiss the report, and record the outcome. (c) If we hide or remove your content or restrict your account, we will tell you and give the reason where the law requires and wherever it is reasonably practicable; you can contest it at support@openoceanhub.com. Hidden content stays visible to its author so that you can see what was affected. (d) Every report upheld against you counts. Repeated upheld reports lead to termination.
5.3 You can block other users; blocking removes their posts from your feed and stops direct messages between you.
6. Your content
On the dock: What you post is yours. You give us the permission we need to store it, show it, resize it, translate it and keep the community's conversations intact, and you promise you have the right to post it.
6.1 You keep every right you have in the text, photos, videos, voice notes, reviews, tracks, documents and other material you submit ("Your Content").
6.2 Licence to us. So that we can run the Service, you grant OpenOcean a worldwide, non-exclusive, royalty-free licence, for as long as Your Content is in the Service, to host, store, back up, reproduce, transmit, display and distribute Your Content within the Service to the audience you chose for it; to resize, compress, transcode, crop, generate thumbnails and previews, apply the edits and filters you chose in the app's editor, and otherwise make technical copies and derivatives needed to deliver it; to translate it when a user requests a translation; and to let other users view, react to, comment on, share within the Service, and reply to it as the Service allows. This licence is sublicensable to the service providers who host and deliver the Service on our behalf. It ends when you delete the content or your account, except as set out in 6.4 and 7.
6.3 To the extent permitted by law, you agree not to assert moral rights against us or our providers in respect of the technical processing above (for example, cropping, compression, thumbnails or translation). Where the law does not allow that, you agree that such processing is not a derogatory treatment of Your Content.
6.4 What survives deletion. When you delete content, it is removed from what other users can see. When you delete your account, your messages and comments remain in other people's conversations attributed to an anonymous "deleted user", and the file behind a photo, video or voice note is not automatically removed from storage (Privacy Policy sections 6 and 14 explain how to have files removed). Content that other users have already saved, screenshotted or shared outside the Service is beyond our reach.
6.5 Your responsibilities. You confirm that you own or have the necessary rights to Your Content, including for any music, images, text, vessel names or people in it; that it does not infringe anyone's rights or the law; and that you have the consent of anyone whose personal data (including a nominated contact's) you submit. You are responsible for Your Content, and we are not obliged to monitor it.
6.6 We may keep copies of removed or reported content as evidence for as long as the report, dispute or legal obligation requires.
7. Contributions to places and anchorages
On the dock: When you add or correct a marina, anchorage, depth, service or review, you are giving it to the map. It stays on the map after you leave, other people can correct it, and everyone reading it knows it is unverified.
7.1 Place and anchorage information you contribute (new places, corrections, marker moves, amenities, prices, contacts, descriptions, reviews, photos, "still right" confirmations, clearance and courtesy-flag reports; together "Contributions") becomes part of the shared map dataset. You grant OpenOcean a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, reproduce, adapt, combine, distribute and display Contributions in the Service and in the map data that powers it, in any medium, with or without attribution, including after you delete your account. Reviews and photos are Your Content under section 6 for as long as they are in the Service; the factual place data they carry stays in the dataset.
7.2 Contributions are unverified information supplied by users, and other users can correct them. We do not guarantee that any Contribution is accurate, complete or current, and section 1 applies to every Contribution you read.
7.3 You may contribute only information you gathered yourself or have the right to share. Do not copy place data, reviews or photographs from other apps, guides, charts or websites into the Service; those are usually someone else's licensed work, and section 5.1(c) and the Copyright Policy apply. Do not add private places (someone's private dock or mooring) without their consent.
7.4 We may edit, merge, move, relabel, reject or remove any Contribution, and decide how it is displayed, in our discretion.
8. Location sharing — what you are agreeing to
On the dock: Your boat's position is shared with other users by default, at "public", until you change it. Your own position is shared with your crew by default, after the app tells you. An SOS is visible to everyone signed in. You choose all of this; know that you are choosing it.
8.1 The Service publishes your boat's position to other users at the visibility tier set for the boat. The default tier is public. You can change the tier, grant or revoke precise access, or stop sharing at any time; the exact behaviour of each tier is described in the Privacy Policy (section 2), which you should read before you sail.
8.2 While you crew on a boat, that boat's captain and crew can see your own position by default unless you pause or switch it off; the Crew screen shows you a one-time notice about this. Being marked aboard when a journey is recorded credits you on that journey.
8.3 Triggering an SOS publishes your position to every signed-in user while the alert is active.
8.4 Positions you see for other boats and people are subject to section 1 and section 5.1(b): they may be stale or wrong, and you may not collect, publish or misuse them.
9. Earned features, paid plans and app-store billing
On the dock: OpenOcean has no paid plan right now. Some features unlock by contributing to the map; they can go to sleep if you stop, and they can be taken away for gaming the system. If we ever sell a plan, Apple or Google will handle the money and the refunds.
9.1 At the time of writing the Service has no paid plan and takes no payments. Nothing in the Service is a purchase, a currency or a store of value.
9.2 Earned Premium. Certain features unlock when your Contributions meet the thresholds shown in the app ("routes"). A Contribution counts once it has stood uncorrected for the period shown; corrections reduce your count. Unlocked features may go to sleep after a period without a counted Contribution and wake when you contribute again. Unlocks are personal, have no cash value, cannot be transferred or sold, and may be changed, withdrawn or revoked — including where we reasonably believe Contributions were fabricated, copied, automated or otherwise made to game the thresholds. Thresholds and routes may change; we will show the current ones in the app.
9.3 If we introduce a paid plan, it will be sold through Apple's App Store or Google Play as an in-app purchase or subscription. The store's own terms will govern payment, billing, renewal, cancellation and refunds; refund requests go to the store, not to us, unless the store directs otherwise. We will publish the price, what it includes and how to cancel before you can buy it, and we will update these terms and the Privacy Policy first. Your statutory rights as a consumer are not affected.
10. Third-party data and licences
10.1 The Service displays data licensed from third parties, each under its own terms. The sources and the attribution and licence notices that apply to them are published at openoceanhub.com/attributions and, where a source requires it, in the app itself; they form part of these terms. In particular:
(a) the base map is provided by Mapbox and uses OpenStreetMap data; you agree to the Mapbox Terms of Service and Privacy Policy (mapbox.com/legal/tos and mapbox.com/legal/privacy) and the OpenStreetMap contributor terms (openstreetmap.org/copyright) to the extent they apply to users of maps built with them; (b) weather data is based on data and products of the European Centre for Medium-Range Weather Forecasts (ECMWF), modified by OpenOcean, under CC BY 4.0; ECMWF does not accept any liability whatsoever for any error or omission in the data, their availability, or for any loss or damage arising from their use; (c) other sources, including national meteorological and hydrographic services, Copernicus Marine Service, open place datasets and a community AIS receiver network, are credited at the attributions page with their licences.
10.2 You may use third-party data only within the Service and only as those licences allow. You may not extract, redistribute or build a product from it.
10.3 Links to third-party websites, webcams, listings or services are provided for convenience. We are not responsible for them, and your use of them is governed by their own terms.
11. The app, updates and changes to the Service
11.1 Licence to you. Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the OpenOcean app on devices you own or control, for your own use aboard — including listing a berth, a boat or your availability as crew — but not to operate the Service as a navigation or safety system for a commercial voyage (section 5.1(i)), and as permitted by the app store's usage rules.
11.2 Updates. The app may download and install updates to its JavaScript code and assets automatically over the air, without going through the app store, when it starts. Updates may change or remove features. You may need to update to keep using the Service.
11.3 We are continually changing the Service. We may add, change, suspend or discontinue any feature, layer, data source or the whole Service at any time. Where a change materially reduces what a paid plan (if any) includes, the store's refund rules apply.
11.4 The app stores some data on your device (cache, settings, drafts). We are not responsible for what happens to it if the device is lost, reset or shared.
12. No professional advice
Nothing in the Service — including weather interpretation, passage suggestions, anchorage and harbour notes, clearance, customs and courtesy-flag guides, safety checklists, maintenance reminders and community answers — is professional navigational, meteorological, legal, customs, medical or safety advice. It is information and other people's opinions. Check it with the proper authority before you rely on it.
13. Intellectual property
The Service, the app, our name and logo, our compiled map and place dataset, our tile and feed formats, and all software and design in the Service belong to OpenOcean or our licensors and are protected by copyright, database and trademark laws. Apart from the licences expressly granted in these terms, no rights are granted to you. "OpenOcean" and the OpenOcean logo are trademarks of OPENOCEAN HUB PTE. LTD. Feedback you send us may be used without obligation to you.
14. Warranties and liability
On the dock: We give you the Service as it is. We do not promise it is accurate, complete or always available. The sea is dangerous and you are in charge of the vessel; we are not liable for what happens on the water. The law where you live may give you rights we cannot take away, and we do not try to.
14.1 As is. To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including any warranty of accuracy, completeness, timeliness, fitness for a particular purpose (including navigation or safety of life at sea), merchantability, non-infringement or uninterrupted, error-free or secure operation. We do not warrant that any data, position, forecast, alert or Contribution is correct, or that any alert will be delivered.
14.2 Assumption of risk. Boating is inherently dangerous. You acknowledge that decisions made in reliance on the Service — including anchoring, routing, timing a passage, entering an anchorage or harbour, relying on a depth or hazard shown or not shown, relying on a forecast or on the AIS layer, and relying on any Safety Feature — are your own, and you assume all risk of loss, injury, death, grounding, collision or damage arising from them.
14.3 Exclusion of liability. To the extent permitted by law, OpenOcean, its directors, employees, contractors, licensors and data providers are not liable to you for any indirect, incidental, special, consequential or punitive loss, or for any loss of vessel, cargo, profit, data, revenue, goodwill or opportunity, or for any death, injury or property damage arising from decisions taken on the water in reliance on the Service, however caused, including negligence, even if we were told it was possible.
14.4 Cap. To the extent permitted by law, our total liability to you for all claims arising out of or in connection with the Service in any twelve-month period is limited to the greater of (a) the amount you paid us for the Service in that period and (b) SGD 500.
14.5 What we do not exclude. Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or under laws that protect consumers, or excludes any right you have that cannot be excluded.
(a) Consumers in the European Union and the United Kingdom. Nothing in these terms affects your statutory rights, including your rights under the laws of your country of residence and, in the UK, the Consumer Rights Act 2015 (including our duty to provide the Service with reasonable care and skill). Sections 14.1 to 14.4 apply only to the extent those laws allow. (b) Consumers in Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value; you are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract. Sections 14.1 to 14.4 do not apply to the extent they would be inconsistent with those guarantees.
14.6 Your indemnity. To the extent permitted by the law where you live, you will compensate us for losses, costs and reasonable legal fees we incur to the extent they were caused by your deliberate or negligent (a) infringement of someone's rights through Your Content or Contributions, (b) breach of these terms or of a data licence in section 10, or (c) misuse of a Safety Feature or of another user's position. This does not apply to consumers to the extent the law of their country does not allow such a clause.
15. Governing law and disputes
On the dock: Singapore law, Singapore courts — except that if you are a consumer in the EU, UK or Australia you keep your local laws and can use your local courts. No forced arbitration, no class-action waiver.
15.1 These terms are governed by the laws of Singapore, and the courts of Singapore have jurisdiction over disputes arising from them, subject to 15.2.
15.2 If you are a consumer resident in the European Union, the United Kingdom, Australia or another country whose law gives consumers mandatory protections, you keep the protection of those laws, and you may bring proceedings in the courts of the country where you live; we may bring proceedings against you only there. Nothing in these terms requires arbitration or waives your right to bring or join a collective action where the law allows it. EU consumers may also use the European Commission's online dispute resolution platform, where available.
15.3 Before starting proceedings, please write to support@openoceanhub.com; we will try to resolve the matter with you within 30 days.
16. Changes to these terms
We may change these terms. When we do, we update the effective date at the top; for changes that materially affect your rights we will email your account address at least 30 days before they take effect and say what changed and why, unless the change is required by law or is needed to address a safety or security issue. If you do not agree with a change, delete your account before it takes effect; using the Service after that date is acceptance.
17. Additional terms for the app stores
17.1 Apple. If you obtained the app from Apple's App Store, the following also apply:
(a) These terms are between you and OpenOcean only, not Apple. Apple is not responsible for the app or its content. OpenOcean, not Apple, is solely responsible for the app. (b) Your licence is limited to a non-transferable licence to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. (c) OpenOcean, not Apple, is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services. (d) OpenOcean is solely responsible for any product warranties, express or implied, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are OpenOcean's sole responsibility. (e) OpenOcean, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of it, including product liability claims, any claim that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation. (f) In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, OpenOcean, not Apple, is solely responsible for the investigation, defence, settlement and discharge of the claim. (g) You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. (h) OpenOcean's name and address for questions, complaints or claims are in section 20. (i) You must comply with applicable third-party terms when using the app (section 10). (j) Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of them Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
17.2 Google. If you obtained the app from Google Play, you acknowledge that Google is not a party to these terms and is not responsible for the app, that OpenOcean is responsible for its support and for compliance with applicable law, and that refunds for any future paid features are handled under the Google Play refund policy.
18. Copyright and illegal-content notices
18.1 We respect intellectual property and act on notices. The Copyright Policy at openoceanhub.com/copyright sets out how to send a copyright notice or counter-notice, how we handle them, and our repeat-infringer policy. It applies to all users.
18.2 Anyone, user or not, can notify us of content they consider illegal by email to support@openoceanhub.com, or in the app by reporting it. We will confirm receipt, act on valid notices without undue delay, and tell the affected user what we did and why.
19. General
19.1 These terms, with the documents they incorporate, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest continues to apply, and the unenforceable part is replaced by the closest enforceable term. Our failure to enforce a term is not a waiver. You may not assign these terms; we may assign them to a successor of the Service with notice to you. These terms are written in English; a translation is for convenience and the English text prevails to the extent the law allows.
19.2 Notices to you may be sent to your account email address or shown in the app. Notices to us go to the address in section 20.
